Trustmark Tactics Used to Deny Insurance Claims
Trustmark has been at the center of various lawsuits regarding their practices of wrongfully denying insurance claims. At Donahue & Horrow, LLP, we have often seen insurance providers such as Trustmark perform the following acts when denying valid insurance claims:

Trustmark has experienced numerous lawsuits and settlements in recent years for denying policyholders’ claims. For example, a plaintiff who worked in a meat-cutting plant suffered a heart ailment that impacted his ability to perform his job. Trustmark alleged that the plaintiff did not disclose all of his underlying medical conditions, thus rejecting his disability claim. Despite initially rejecting the disability claim, the company eventually reached a settlement with the plaintiff.
In another case filed against Trustmark, a chiropractor experienced a bicycle accident that left him temporarily paralyzed with permanent injuries to his spine and back. His Trustmark policy had an exclusion for any injuries related to his neck. Trustmark denied his claim and alleged that the plaintiff’s injuries were unrelated to his neck to avoid paying out his claim. However, doctors showed that the insured’s injuries were related to his neck, in addition to the spinal cord and the back, and the long-term disability benefits were eventually honored.
Finally, in another case, a food market manager also suffered from a heart ailment and had previously purchased a disability insurance plan from Trustmark to protect his financial security for this very reason. When his condition worsened, he couldn’t return to work, and Trustmark alleged that the plaintiff did not disclose this ailment prior to purchasing the disability policy. Witness testimony proved otherwise, and as a result, Trustmark settled for an amount more than it would have cost for them to pay out the initial claim.
