Family of Birth Injury Victim Receives $3.75M Settlement

With the help of Donahue & Horrow, a family was able to obtain a $3,750,000 settlement for the lifetime care of their son with severe brain injury and permanent disability caused by medical negligence. Before his birth, our client’s mother showed no sign of distress and had a normal and uncomplicated pregnancy.  Regrettably, when she showed up at the hospital to give birth, she received badly mismanaged care that resulted in an emergency c-section that was not performed soon enough and resulted in permanent injuries to her son.  When her son was born, he required resuscitation and transfusions and was quickly transferred to a Children’s Hospital where he underwent surgery to reduce brain swelling.  Eventually, our client was diagnosed with Hypoxic Ischemic Encephalopathy (HIE), hydrocephalus (commonly known as water on the brain) and cerebral palsy.  Unfortunately, as a result of these conditions, this young boy will never be gainfully employed, and will likely require around-the-clock care for the remainder of his life.

While the defendants denied any culpability for our client’s injuries, the Donahue & Horrow team conducted a diligent review of the medical records, multiple depositions and probing expert reports , and were able to convince the defendants to make substantial payments toward a settlement.  This money will allow the family to afford the care that the young child will need for the rest of his life.
