$5.45 Million Settlement Secured In Birth Injury Case

Donahue & Horrow LLP obtained a $5,450,000 settlement for a mother and her two-year-old son following a negligent prenatal and labor and delivery that injured the baby, causing not only a brain injury (hypoxic-ischemic encephalopathy) but also spastic quadriplegic cerebral palsy.

Following a non-complicated pregnancy, our client, a young mother, went to the hospital to give birth to her son.  Unfortunately, the hospital and her doctors performed their duties well below the standard of care.  One example; despite signs during labor that the baby was in distress, neither the attending physicians nor hospital employees acted quickly enough to ensure the baby was delivered quickly and healthy.  Additionally, after the baby was born, the physicians failed to properly follow “the cooling protocol,” standard in such cases.  As a result, the baby has severe and permanent injuries.
