$4.75 Millon Dollars Awarded in Wake of Ralph’s Grocery Semi-Truck-Caused Accidental Death

Representing the wife of a driver who died in a freeway accident with a Ralph’s Grocery semi-truck, Michael Horrow, one of the founding partners of Donahue & Horrow LLP, secured a $4.75 million dollar jury verdict for wrongful death in San Bernardino County.

Our client’s husband was driving on the freeway when he ran into the back of a Ralph’s Grocery Company big rig that was illegally parked on the side of the freeway.  The driver suffered massive injuries and died at the scene.  During the trial, Ralph’s repeatedly moved for a nonsuit on the grounds that neither Ralph’s nor its driver owed our client’s husband any duty, and that the truck driver’s negligence (in parking on the side of the freeway to eat a sandwich, rather than pulling off the freeway) did not cause the collision.

The court rejected those motions based in part on the testimony of experts retained by Donahue & Horrow LLP, and the jury found that Ralph’s and its driver were negligent, and therefore, liable to our client for causing her husband’s death.
