Michael Horrow Secures Settlement For Grieving Widow In An Accidental Death and Dismemberment Lawsuit Against Federal Insurance Company

After a hard-fought battle with the Federal Insurance Company in the case of an accidental death, Donahue & Horrow LLP was able to reach a very favorable settlement for our client worth more than double the full value of the insurance contract.

In August 2019, our client, residing in San Diego County, found her 75-year-old husband on the floor of their bedroom lying on his left side, breathing, but not responsive. Tragically, he had fallen out of bed. Prior to the accident, his overall health was stable, and his physicians agreed that his accidental fall was the proximate cause of his untimely death. Despite this overwhelming evidence, the accidental death and dismemberment (AD&D) insurance company, that he had diligently paid for over the course of many years, refused to pay his widow’s claim.

During the mediation, Michael Horrow, a founding partner of Donahue & Horrow LLP, noted all the ways the insurance company’s investigation was deficient and ignored the basic facts presented in the medical evidence. Of note, Mr. Horrow pointed out that the claims adjusters who investigated this claim on behalf of the insurance company failed to undergo the proper training required to handle claims in California.

By the end of the mediation, the insurance company agreed to a settlement so significant that it will allow the family, not only to recover all of the benefits they were due under the policy, but also provide them with additional funds to compensate them for the pain and suffering caused by the insurer’s actions.
