Michael Horrow Speaks at CAALA’s 34th Annual Convention in Las Vegas

Southern California consumer attorney Michael B. Horrow was a guest speaker at The Consumer Attorneys of Los Angeles (CAALA) 34th Annual Las Vegas Convention, the nation’s largest trial lawyer convention. The event, which ran from Thursday, September 1 through Sunday, September 4, 2016 was held in Las Vegas and was widely attended by hundreds of attorneys.

Michael Horrow is AV rated as a lawyer, the highest distinction for lawyers recognizing both ability and ethics. He was voted a Southern California SuperLawyer by his peers and before a SuperLawyer “Rising Star.” He has tried lawsuits in State and Federal Courts throughout California and lectured on issues of insurance coverage and insurance bad faith to the ABA and various other prominent consumer organizations. From 1998 to today, the sole focus of Mr. Horrow’s practice has been in insurance bad faith.

Nichole Podgurski is an associate who handles cases in all areas of the firm’s practices, including the Consumer Litigation Department, Medical Malpractice, Elder Abuse and Personal Injury, and insurance cases. Ms. Podgurski has been selected and honored as a Super Lawyer Rising Star in 2013, 2014, 2015, and again in 2016.

Horrow and Podgurski authored an article, “Damages – Contractual and Extra-Contractual” that was part of conference materials. The article explains what damages plaintiffs may be entitled to after prevailing on claims for breach of contract and implied breach of contract and practical tips on asserting your client’s rights.

…”The only type of case in which California allows punitive damages to be awarded based on the breach of a contract is an insurance case. The reason for this is that the relationship of insurer and insured is inherently unbalanced, and “the availability of punitive damages is thus compatible with recognition of insurers’ underlying public obligations and reflects an attempt to restore balance in the contractual relationship.” …
