Long-Term Care Insurance Claim Denials and Delays
Has your insurance claim for long-term care been wrongfully denied? Our lawyers can help.
Long-term care insurance is an insurance product that offers coverage for care that can be costly and that is typically not covered by private health care insurance or government programs such as Medicaid.
Private health insurance and government programs typically only cover skilled nursing care. Long-term care insurance covers care that is necessary for a person to live independently and still maintain quality of life. This care involves activities of daily living, or ADLs, such as bathing, dressing, preparing meals, walking and other daily activities. Long-term care insurance can provide coverage that keeps elderly or frail adults in their homes, rather than allowing them to deteriorate to a condition that requires skilled nursing in a nursing home or other medical facility.
If your claim for long-term care benefits has been denied, a lawyer at Donahue & Horrow can help you understand your rights and options. Contact us today for a free consultation. We serve clients in the Los Angeles area and statewide throughout Southern and Northern California.
Limits of Long-Term Care Coverage
Long-term care insurance typically provides reimbursement up to a set amount each day, such as $100 or $150, for providers to assist with activities of daily living in a policyholder’s home or even in an institution. To be covered, the policyholder must be disabled within the meaning of the policy, such as someone who can no longer perform activities of daily living (ADLs) or someone who has a cognitive impairment.
As attorneys handling insurance claim denials, we have seen insurers deny long-term care coverage for persons suffering from Alzheimer’s or dementia and in other instances where policyholders or their family members are unaware of their rights under the policy.
At Donahue & Horrow LLP, we assert the policyholder’s rights to coverage under the policy because we understand the physical, emotional and financial impact if the policyholder has to enter a skilled nursing facility after deteriorating at home. We want our clients to receive the care that they are entitled to, and to stay in their home or maintain the best quality of life possible, especially when they have purchased an expensive long-term care policy for this very reason.

“I’m sure you heard the news. Wow, what an experience! I was totally overwhelmed with the process, emotionally bankrupt. At the end of the day, I think I was in total shock. I wondered around in an emotional daze for hours. The good news, I woke up to a Brand New Day. I haven’t seen this kind of day in years. Just thought I would share that with you.
I also want to thank you for all your hard work. I know Michael could not have done what he did without you. You have been so valuable through this whole process. It is people like you that make people like me believe. Your work is impressive but, what I feel you represent as a human being is most impressive. I felt you holding my hand, and I am grateful to you for that. You are amazing. You were at the pulse of the case at all times. Not once did I feel that I needed to talk to Michael for clarification (a first for me, especially, in the legal world). You have been so helpful, and kind, and so supportive, and…
Thank you Nichole, for all you have done on my behalf. There are not enough words (at least in my vocabulary) to express my gratitude.” — RS
