The Number of Long-Term Care Claim Denials is on the Rise

Are you caring for an adult loved one who is getting long-term care (LTC) insurance? At Donahue & Horrow, L.L.P., we have seen a disturbing trend involving this type of insurance and a rise in the number of insurance claims are being unfairly underpaid or delayed, if not outright denied.

Insurance companies are taking advantage of the fact that people in your position — children and other relatives of adults in need of long-term care — are often pressed for time and are not familiar with insurance industry practices and terminology. Between working, raising children of your own and caring for an adult loved one, you simply do not have time to look through all of the small print in a long-term care insurance policy.

Because all LTC policies have limitations on how much they will pay, for how long, and for what expenses are covered you may not even know that your loved one is not getting all the benefits that he or she is actually entitled to receive.

What is Long-Term Care Insurance and what does it cover?

Long-term care insurance (LTC or LTCI), is an insurance product (type of insurance) that consumers can purchase to help provide for the cost of long-term care beyond a predetermined period of time. Long-term care insurance covers care that is generally not covered by health insurance, Medicare, or Medicaid.

LTC is different from traditional health insurance which has many limitations regarding long-term patient care. You can select a range of care options and benefits that allow you to get the services you need, where you need them. For example, long-term care insurance policies reimburse policyholders a daily amount (up to a certain limit that varies between policies based on the carrier and scope of coverage) for services to assist policyholders with activities of daily living such as bathing, dressing, or eating.

Long-term care insurance is designed to cover long-term services that include personal and custodial care in a variety of settings such as your home, a community organization, or other facility. Your policy may cover care for two years, five years, or even offer coverage for lifetime care, and because long-term care can be expensive, insurance companies often look for ways to deny claims or to reduce the amount of benefits that they pay on individual claims.
